By accessing primeplaypicks.com and purchasing any information, recommendations, subscriptions, text-message alerts, or related services (collectively the “Services”) offered by Prime Play Picks, LLC (“Prime Play Picks,” “we,” “our,” or “the Company”), you agree to all of the terms and conditions below.

1. Eligibility
You may use the Services only if you are at least 21 years old and legally competent to enter into this agreement, whether on your own behalf or for a business you represent. Any registration, use, or access by anyone under 21 is strictly prohibited.

2. Nature of Service & No-Bet Placement
Prime Play Picks is not a sportsbook and will never place bets on your behalf. Our content is provided solely for entertainment and informational purposes.

3. No-Refund Policy
All sales are FINAL—NO REFUNDS or credits will be issued once any portion of the Service (including email or SMS delivery) has been transmitted or made available to you.

4. SMS / Text-Message Policy
(1) Opt-In Requirement – By checking the SMS box at checkout or texting a keyword to our dedicated number, you expressly consent to receive promotional and transactional texts from Prime Play Picks.
(2) Frequency – Up to 3 messages per day, typically before 2 PM CT on game days.
(3) Cost – Message and data rates may apply.
(4) Opt Out – Text STOP at any time to cancel or HELP for assistance.
(5) Supported Regions – U.S. and Canada only; delivery may vary by carrier.

5. Risk Disclosure
Sports wagering involves significant financial risk and is not suitable for everyone. Bet only what you can afford to lose. Past performance does not guarantee future results. Prime Play Picks offers no promise of profit or immunity from loss.

6. No Fiduciary Duty & Limited License
No fiduciary relationship exists between you and Prime Play Picks. Services are for your personal, non-commercial use. You may not copy, resell, distribute, or modify any content without prior written consent.

7. Intellectual-Property Notice
All materials on primeplaypicks.com are protected by U.S. and international copyright laws. Unauthorized use is prohibited.

8. Limitation of Liability
Prime Play Picks’ aggregate liability for any claim shall not exceed the amount you paid for the Services giving rise to that claim. In no event shall we be liable for lost profits or any special, incidental, consequential, or punitive damages.

9. Disclaimer of Warranties
Services are provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties—express, implied, or statutory—including merchantability, fitness for a particular purpose, title, and non-infringement.

10. Force Majeure & System Outages
We are not liable for delays or failures caused by events beyond our reasonable control, including internet outages, natural disasters, wars, strikes, or regulatory actions.

11. Electronic Communications & Notices
You agree to receive all communications electronically at the email and/or phone number you provide. You are responsible for keeping your contact information current and for promptly reviewing all communications.

12. Indemnification
You agree to indemnify and hold harmless Prime Play Picks and its officers, employees, partners, and affiliates from any claim or demand arising out of your use of the Services or violation of these Terms.

13. Privacy & Data Disclosure
We may disclose personal information when required by law or when necessary to protect our rights, property, or safety, or that of our users or others.

14. Modifications
We may update these Terms of Use at any time. Continued use of the Services after changes become effective constitutes your acceptance of the revised Terms. Changes mandated by law take effect immediately.

15. Governing Law & Severability
These Terms are governed by the laws of the State of Texas. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
